- Technical or functional performance issues.
- Claims related to third-party integrations or tools implemented post-delivery.
You agree that any issues arising after the project is verified will not be our responsibility, and any claims made after the completion and verification will not be entertained. Kotech Solutions will have no further obligation to support, maintain, or update the Deliverables unless a separate maintenance agreement is established.
2. Intellectual Property Rights
For all custom-developed websites, software, or digital products, Kotech Solutions retains ownership of the intellectual property rights associated with the project unless otherwise expressly agreed in writing. These rights include, but are not limited to:
- Source code
- Design elements
- Proprietary content
- Visual assets and graphics
While you will have the right to use the Deliverables for your business purposes, the intellectual property (including any bespoke code or unique design features) remains the exclusive property of Kotech Solutions.
If you require full ownership or rights transfer of the intellectual property, such an agreement must be negotiated in writing and may be subject to additional fees.
Note: Any modifications made to the Deliverables by you or third parties after the handover may result in a loss of warranty or support from Kotech Solutions unless a prior agreement is made.
3. Limitation of Liability After Contract Completion
Once the project has been completed and verified, Kotech Solutions will not be responsible for:
- Changes or modifications made to the Deliverables by you or any third party.
- Any claims related to third-party tools, plugins, or services added after the final handover.
- The performance or integration of third-party applications or services.
- Future technological, legal, or regulatory changes (e.g., changes in copyright law or compliance requirements).
Additionally, Kotech Solutions will not be liable for any claims arising from your use of the Deliverables beyond the originally agreed scope or outside the environment in which they were tested.
4. Data Collection and Use
We may collect personal and business information, including but not limited to:
- Your name, business name, email address, phone number, and other contact details.
- Information related to your projects, including website URLs, branding preferences, and marketing goals.
This information is collected to:
- Provide our Services and communicate effectively with you.
- Fulfill our contractual obligations related to your project.
- For billing and invoicing purposes.
Kotech Solutions does not sell, rent, or otherwise share your personal information with third parties except as required by law or to provide the Services you have contracted us for.
